Welcome to The Scaling Engine. These Terms of Service ("Terms") govern your access to and use of all products, services, courses, coaching programs, community features, and content offered by The Restaurant Scaling Engine LLC ("The Scaling Engine," "we," "us," or "our") through thescalingengine.com and our affiliated platforms.

By purchasing any product, creating an account, or using our services, you agree to these Terms. If you do not agree, please do not use our services.

1. What We Offer

The Scaling Engine provides digital education, coaching, and community services for restaurant owners. Our current offerings include:

• Management OS ($97): A self-paced digital course delivered through Circle.
• Scaling Engine OS ($297): A comprehensive digital course with community access, delivered through Circle.
• Founders Board ($20,000/year, or $2,000/month): Live group coaching, community access, AI coaching tools, and course access.
• Private Advisory ($50,000/year, or $5,000/month): One-on-one advisory, live coaching, full platform access, and priority support.

2. No Guarantee of Results

Our programs provide education, frameworks, and coaching for restaurant business owners. We do not guarantee any specific financial results, revenue growth, or business outcomes.

Your results depend on many factors we cannot control, including your effort, your market, your team, your existing business, and how you apply what you learn. Testimonials and case studies shared on our website or in marketing materials represent individual results and are not promises of what you will achieve.

We stand behind the quality of our content and coaching, but we cannot and do not promise that our programs will produce any particular result for your business.

3. Your Account

When you purchase a product, you will receive access to the platform and features included in your specific tier. You are responsible for:

• Keeping your login credentials secure.
• All activity that occurs under your account.
• Not sharing your account access with others.

Your access level is tied to the product you purchased. Upgrading to a higher tier requires a separate purchase. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments

All payments are processed securely through Stripe via GoHighLevel. By making a purchase, you agree to provide accurate payment information and authorize the applicable charges.

For subscription or installment-based products (Founders Board, Private Advisory), you authorize recurring charges according to the payment schedule agreed upon at purchase. If a payment fails, we will attempt to contact you to resolve it. Continued non-payment may result in suspension of access.

5. Intellectual Property

All course content, frameworks, templates, tools, videos, written materials, coaching methodologies, and community content created by The Scaling Engine are our intellectual property or are used under license.

When you purchase a program, you receive a personal, non-transferable, non-exclusive license to use the materials for your own business. You may not:

• Copy, redistribute, or resell any course materials.
• Share login access or downloaded materials with non-purchasers.
• Use our frameworks, templates, or content to create competing products or coaching programs.
• Record, screenshot, or redistribute coaching calls without written permission.

Violation of these terms may result in immediate termination of access without refund.

6. Community Guidelines

Our community spaces (Circle, coaching calls, group chats) are shared environments. By participating, you agree to:

• Treat other members with respect.
• Keep discussions relevant and constructive.
• Not spam, solicit, or promote unrelated products or services.
• Not share other members' personal information or business details outside the community.
• Not engage in harassment, discrimination, or abusive behavior of any kind.

We reserve the right to remove any member who violates these guidelines, with or without notice, and without refund.

7. Limitation of Liability

To the maximum extent permitted by law:

• The Scaling Engine and its owners, employees, coaches, and contractors are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of our products or services.
• Our total liability to you for any claim related to our services is limited to the amount you paid for the specific product in question.
• We are not responsible for decisions you make based on information provided in our courses or coaching. You are solely responsible for your business decisions.

8. Third-Party Platforms

Our services rely on third-party platforms including Circle (course delivery), Stripe (payments), GoHighLevel (CRM and communications), and others. We are not responsible for outages, changes, or issues caused by these third-party services. We will make reasonable efforts to resolve any access issues promptly.

9. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. For material changes, we will notify you by email.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services will be resolved in the courts of Florida.
